U.S.A. Student Visa New Rules: A Complete Guide

The proposed framework fundamentally alters how international students manage their authorized stay in the United States. Below are the core highlights of the new policies.

1. The End of “Duration of Status” (D/S)

Historically, F, J, and I visa holders were admitted under the “Duration of Status” (D/S) system. This meant you could legally remain in the U.S. for as long as you were actively enrolled in a recognized educational program, without a specific expiration date on your I-94 record.

Under the new proposal, the D/S framework is ending. Instead, your authorized stay will be strictly limited to the duration of your specific academic program, subject to a hard maximum stay of 4 years.

2. Mandatory USCIS Extension of Stay (EOS)

In the past, if a student needed more time to complete their degree—perhaps due to a double major or a necessary reduced course load—their university’s Designated School Official (DSO) could easily manage the extension internally.

Moving forward, universities will lose this administrative power. Students requiring additional time to complete their studies will be required to apply directly to the U.S. Citizenship and Immigration Services (USCIS) for an official Extension of Stay (EOS).

3. Enhanced Compliance and Background Checks

Because EOS applications are moving under the direct jurisdiction of USCIS, the process will become significantly more rigorous. The new rule states that extension applications will be subject to mandatory biometric data collection, deep background checks, and stringent fraud-prevention screenings. This means longer processing times and a higher burden of proof for the student.

4. Reduced Post-Graduation Grace Period

Currently, F-1 students enjoy a 60-day grace period after completing their academic program or Optional Practical Training (OPT). This window allows students to prepare for departure, transfer to a new institution, or apply for a change of visa status (such as an H-1B).

The proposed rule slashes this timeline in half. The post-completion grace period will be strictly reduced from 60 days to 30 days.

5. Stricter Rules for Academic and Program Changes

The government aims to crack down on continuous enrollment without a legitimate academic progression. Expect to see substantial additional restrictions and compliance requirements if you wish to change your major, switch degree levels, or transfer programs. While further implementation guidelines are awaited, “course cycling” to indefinitely extend a stay will become incredibly challenging.
